R19: Need to reduce tensions and build confidence in the Eastern Mediterranean

• Reiterate that ending the Turkish occupation of the northern part of the Republic of Cyprus remains a priority. It should be done within the framework of decisions taken by the United Nations and the EU acquis, without military intervention by any country. We support the forces that seek rapprochement, on both sides and solidly support their position on finalising a bi-zonal bi-communal federal solution to the Cyprus problem as articulated and agreed upon as a base in all UN peace talks since 1975. We further support single sovereignty for Cyprus as a country within this framework. We call for increased solidarity with Turkish Cypriots by the EU and that their fate is not left, as EU citizens, at the whims of an external government.

No outsourcing of obligations to protect human rights of asylum seekers and migrants

The European Greens are uncompromising on defending the rights of asylum seekers and migrants; we believe that the EU has a role to play in this respect, in terms of harmonizing legislation, defining common policies and ensuring their implementation.

The ongoing initiatives of the EU and its Member States to keep out asylum seekers and migrants as much as possible so as to escape responsibility for protecting their rights, call for a principled response. We must acknowledge that outsourcing the responsibility of protecting asylum seekers and migrants as part of the EU’s border management policy inevitably means giving up any guarantees of their human rights actually being protected. Any measure entailing such outsourcing should therefore principally be rejected.

While the EU has established a Common European Asylum System, which inter alia lays down the criteria and procedures for establishing whether a person is eligible for international protection and the reception conditions for asylum seekers, a great number of EU Member States have shown persistent in avoiding to take responsibility for the effectuation of these rules. Indeed, pushbacks of asylum seekers and migrants by Member States, assisted by Frontex, have prevented them from exercising their right to seek asylum. In addition, the poor reception conditions of asylum seekers in a number of Member States, in some cases even qualified as violation of the prohibition of degrading treatment, as well as the misuse of Dublin proceedings by Member States, have discouraged asylum seekers from coming to the Member State concerned, or compelled asylum seekers to move to other Member States after their arrival.

On top of this, non-EU states, such as Belarus and Morocco have recognised the unwillingness of EU Member States to take responsibility for the reception of asylum seekers and migrants as a profitable weak spot in the EU’s external relations. This has led to the instrumentalisation of asylum seekers and migrants by these states for the purpose of achieving economic and political goals. The aim to avoid responsibility for the protection of asylum seekers and migrants should thus be considered as a direct cause of migrants not being assured of the non-refoulement principle, the prohibition of being subjected to degrading treatment, and of the protection of a number of other fundamental rights that are of particular importance in the context of asylum.

The EU has nevertheless proven persistent in wanting to avoid taking on responsibility for the protection of the rights of asylum seekers and migrants. This follows from the numerous deals with non-EU states with the aim of externalising migration policies, the refusal of Member States to renegotiate the country of first entry principle of the Dublin System that currently puts a disproportionate strain on those member states situated at the EU's external borders, and notably, the Commission proposal of December 2021 for an Instrumentalisation Regulation.
The proposal introduces a mechanism which allows member states to derogate from their responsibilities under the EU asylum acquis in situations of “instrumentalisation” of migration. The proposal has been strongly criticised in a joint statement of 80 NGO’s following a report by ECRE.
Importantly, all thereforementioned EU initiatives are based on the assumption that it is in fact possible to externalise the responsibility for the protection of the rights of asylum seekers and migrants, or to leave the responsibility for the reception of asylum seekers to only a few Member States, without necessarily detracting from the protection of their fundamental rights. Indeed, the proposals to the migration deals, the Dublin Regulation and the Instrumentalisation Regulation, all stress the importance of securing the protection of human rights and therewith suggest that this is feasible.

The problem with this view is that it fails to recognise that what is being outsourced here is not just any task, but a legal obligation. That it is impossible to outsource an international human rights obligation and be guaranteed of the protection of the human rights at stake, can be explained as follows: if the EU would choose to refuse to perform a task for which there is no legal obligation, this is self-evidently unproblematic.
The same goes for outsourcing such a task. Indeed, a possible failure of the other party to fulfil the task has no serious consequences, since there was no real obligation to perform the task in the first place. This is different in case of an international or European legal obligation. The EU cannot just choose not to perform the task concerning the reception of asylum seekers who arrive at the borders of the EU, because this would come down to a clear and deliberate violation of its international or European legal obligations.
In the same way, the EU cannot just outsource such an obligatory task and not care about the fulfilment of the task, because this would come down to deliberately accepting the violation of its obligations. Outsourcing a legal obligation therefore makes the EU vulnerable for manipulation. In addition, in case of a failure to perform the outsourced task, the EU has no means of pressuring the other party into committing to its obligations.

The European Green Party calls on the EU to recognise that the human rights violations in the context of border controls and the reception of asylum seekers are the direct and inevitable result of attempts of EU Member States themselves wanting to escape responsibility for the protection of the human rights of asylum seekers and migrants by leaving this obligation to non-EU states or to only a few Member States.

The European Green Party calls on the EU to acknowledge that outsourcing the responsibility of protecting the human rights of asylum seekers and migrants to other parties or to leave this responsibility to only a few Member States, inherently means giving up all guarantees of those human rights actually being protected, due to the leverage this provides to those other parties or Member States.

The European Green Party calls on the European Commission to withdraw the proposal for an Instrumentalisation Regulation, in any case to the extent that the proposal allows member states to derogate from their responsibilities under the EU asylum acquis.
